Terms of Service
1. Using Velvet
These Terms govern your use of the Velvet app and website provided by VELVET AI, Inc. By using Velvet, you agree to them. If you do not agree, do not use the service. You must be at least 13 years old, or 16 in the EU/EEA, and have the legal capacity or required permission to agree to these Terms.
2. Accounts and service
Velvet offers fashion discovery, styling tools, AI chat, Digital Double and virtual try-on features, a wardrobe, and community features. You are responsible for keeping your account credentials secure and for activity through your account. Availability and features may change, and some actions require a Look balance or a purchase.
3. Content, profiles, and sharing
You may upload photos, text, profile information, and Looks. You retain rights you have in your content and must have the rights and permissions needed to submit and share it. You grant Velvet a non-exclusive license to host, process, reproduce, and display that content as needed to provide the service and according to your sharing choices. This license ends when the content is removed from our service, except for lawful retention and copies others already received.
You can choose a public or private profile and an audience for each Look. Public profiles can be found and featured; a private profile requires an accepted follow request for others to see its Looks. Content shared outside Velvet may remain available to recipients after you change a setting or delete it from Velvet. Recognition badges and status reflect activity in the service; they do not verify identity, expertise, or endorsement by Velvet.
4. Community rules
Do not post unlawful, infringing, deceptive, abusive, sexually exploitative, or otherwise harmful content; impersonate others; harass or threaten people; misuse their images; interfere with Velvet; or access accounts or data without permission. You can report content or users and block users in the app, or contact us at info@velvet-ai.app. We may review reports and remove content, limit visibility, or suspend accounts to protect users and enforce these Terms.
5. AI output
AI-generated styling and virtual try-ons may be inaccurate or approximate and do not guarantee fit, appearance, availability, or suitability of a product. You are responsible for decisions you make using the results. Third-party products or shopping links are governed by their sellers' terms; Velvet may earn a commission from some qualifying purchases.
6. Looks and one-time packs
A Look is an in-app unit used for eligible creation actions. The app shows the number of Looks required before a paid action. Free, promotional, and subscription Looks may have refill or expiration dates shown in your wallet. A one-time Look pack is a consumable in-app purchase that adds Looks to your Velvet account. Purchased Looks do not expire while your account remains active, but they are used when you spend them, have no cash value, and cannot be transferred or exchanged for money. If a purchase is refunded, we may adjust the related balance, including future Looks if the refunded Looks were already used.
7. Velvet+ subscriptions
Velvet+ is offered as monthly and annual auto-renewing subscriptions. Each plan grants the period's Look allowance and the benefits shown in the purchase screen. Subscription Looks are available during the applicable subscription period and do not carry over after that period. Apple charges your Apple Account at the price and interval displayed before you confirm the purchase. Your subscription renews automatically unless you cancel it through your Apple subscription settings before renewal. You retain access through the paid period after cancellation, subject to Apple's billing and refund decisions.
You can view or manage your plan and restore a subscription in the app's Subscription screen. Use Looks & Purchases to check a missing Look pack balance. Deleting your Velvet account does not cancel a subscription billed by Apple; cancel it separately through Apple. Plan availability, localized prices, and any offer terms are displayed before purchase.
8. Billing and refunds
Apple processes iOS in-app purchases. To request a refund for a subscription or Look pack purchased through Apple, visit reportaproblem.apple.com. Apple determines eligibility under its rules and applicable law. Your mandatory consumer rights remain in effect. For a missing entitlement or balance, use the app's purchase-help controls or contact us.
9. Intellectual property and providers
Velvet's software, branding, and service content are owned by Velvet or its licensors. These Terms do not transfer those rights to you. Do not copy or redistribute the service without permission. The service uses third-party providers for AI processing, authentication, storage, analytics, and purchase handling. Our Privacy Policy explains how personal information is handled.
10. Suspension and deletion
We may remove content or suspend or terminate an account for violations, fraud, safety concerns, or legal requirements. You may delete your account in the app. Account deletion does not reverse completed purchases or automatically cancel a store subscription.
11. Liability and disputes
To the extent permitted by law, Velvet is not responsible for inaccurate AI output, styling or third-party purchase decisions, or losses beyond the greater of US$50 or the amount you paid Velvet in the preceding 12 months. This does not limit liability or consumer rights that cannot lawfully be limited.
Delaware law governs these Terms, except where mandatory local law applies. For US users, disputes are subject to binding arbitration in Delaware, except eligible small claims matters; class actions are waived to the extent permitted by law.
12. Changes and contact
We may update these Terms and post a revised effective date. We will give additional notice when required. Continued use after the effective date means you accept the updated Terms where the law permits. Contact VELVET AI, Inc. at info@velvet-ai.app.
